1. Application and acceptance
Submitting a Founding 55 or other application does not guarantee acceptance. A business becomes an active 555 participant only when we approve its participation or otherwise confirm the arrangement.
2. Independent business
You remain an independent business. Unless a separate written agreement expressly says otherwise, 555 is not your agent, reseller, employer, franchisee, payment processor or partner in the legal sense.
3. 0% sales commission model
The standard 555 model does not take a percentage commission from a seller’s direct sale. You keep your own checkout, payment relationship and customer relationship. Separate platform, media, production, sponsorship, studio or promotional fees may apply only if they are clearly agreed with you.
4. Your responsibilities
You are responsible for the accuracy and legality of your business information, products, services, prices, availability, claims, advertising, licences, qualifications, product safety, fulfilment, bookings, delivery, returns, refunds, warranties, consumer guarantees, taxes and customer service.
You must comply with the Australian Consumer Law and any other laws, industry rules or professional obligations that apply to your business.
5. No misleading claims
You must not publish false or misleading prices, fake discounts, fabricated stock levels, fake reviews, fake participation counts, fake LIVE status or claims you cannot substantiate. Any comparison, health, performance, financial or professional claim must be lawful and supportable.
6. LIVE and media content
You are responsible for what you say or demonstrate during your LIVE stream or supplied media. You must have permission to use music, footage, logos, images, testimonials and other third-party material. You must not stream unlawful, unsafe, discriminatory, defamatory, infringing or deceptive content.
7. Content licence to 555
When you provide business information, logos, product images, clips, LIVE recordings or other content for 555, you grant us a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, format and promote that content for operating and marketing the 555 network and your participation. You keep ownership of your content. You can ask us to remove future use, subject to reasonable archival, legal or already-produced media requirements.
8. Products, services and external checkout
Where a user clicks through to your website, store, booking service or enquiry process, you are responsible for that process and its terms, security and privacy. You must provide customers with legally required business information and consumer remedies.
9. Offers and Group Deals
Specials and Group Deals must use genuine prices, genuine targets and genuine participation information. You must clearly state any important conditions, expiry, quantity limits or eligibility requirements. Reaching a displayed interest target does not itself create a completed customer transaction unless your offer terms clearly say so.
10. Aussie Coins and rewards
If you participate in an Aussie Coins or partner reward, you must honour the published benefit in accordance with the specific offer terms. Partner-funded rewards remain subject to the separate Rewards Terms and any campaign conditions.
11. Leads and privacy
If a user provides personal information to you through an enquiry or other interaction, you are responsible for handling that information lawfully and securely and for your own privacy and marketing obligations.
12. Review, suspension and removal
We may review, pause, refuse or remove content or participation where we reasonably believe it is unlawful, misleading, unsafe, infringing, inconsistent with these terms or likely to damage users or the network. Where appropriate, we will try to give the business an opportunity to correct an issue.
13. Fees and future services
No fee is created merely by these website terms. Any paid membership, production package, sponsorship, studio use or other paid service must have its price and relevant terms communicated before you commit to it.
14. Consumer law and liability
Nothing in these terms excludes rights or liabilities that cannot lawfully be excluded. To the extent permitted by law, each party remains responsible for its own acts, omissions, representations and legal obligations.
15. Changes
We may update these terms as 555 moves from pilot to commercial operation. Material changes will apply prospectively and will be published on this page.
