Website Terms & Conditions
Effective date: 18 October 2026
These website terms apply to the use of 555.com.au, operated by Nickon Enterprises Pty Ltd (ABN 83 113 927 432), trading as 555 (“we”, “us”). By using this website, you agree to the terms below. The scope, fees, deliverables and conditions of a paid engagement will be set out in a separate written quote, proposal or service agreement, which takes precedence where it conflicts with these website terms.
1. Website information
Our site provides general information about digital, AI, creative and business development services and our owned platforms. Information, examples, features and indicative prices may change. Content is not financial, legal, technical security or other regulated professional advice. We aim to keep information accurate but do not warrant that the website is complete, uninterrupted or error-free.
2. Pricing, scope and GST
Prices displayed on this website are indicative starting prices in Australian dollars (AUD) and exclude GST, unless clearly stated otherwise. Advertised starting prices do not constitute an offer to supply every project at that price. An individual written quote or signed agreement defines the exact inclusions, exclusions, timing, revisions, third-party subscriptions, expenses, support and payment milestones. Additional work, integrations, hosting, domain registration, advertising spend and software licence charges are excluded unless expressly included in writing.
3. Enquiries and engagements
Submitting a contact or quote form does not create a contract or guarantee acceptance of a project, delivery date, result or response time. Work begins only when we and the client accept an agreed proposal or agreement, including any required deposit. Fees, payment due dates, changes, pauses, cancellation arrangements and ownership of deliverables are governed by that agreed proposal or agreement. We will not assume that a client has authorised a material scope change without agreement.
4. Client responsibilities
Clients are responsible for providing accurate instructions, necessary materials, permissions and timely approvals. Clients must have rights to supply their logos, photos, text, business data and other content, and must review factual, commercial and legal statements before publication. Clients remain responsible for their own statutory compliance, business decisions and customer commitments. We may reasonably pause work where necessary information, approvals or payments are outstanding, subject to the agreed contract and applicable law.
5. AI, automation and third-party platforms
AI-assisted outputs may be inaccurate or incomplete and must be checked by an appropriate person before business-critical use or publication. Automation and integrations depend on third-party services, availability, pricing, compatibility and agreed testing. We do not guarantee automated decisions, response accuracy, uninterrupted operation, particular search rankings, website traffic, customer leads, sales, revenue or other commercial results. Any specific performance commitment must be separately agreed in writing.
6. Intellectual property
Our website, brand, layout and original content are protected by applicable intellectual property laws. Unless we give permission, you must not reproduce our materials commercially or misrepresent affiliation with us. A client’s rights to deliverables, source materials, third-party assets, licences and pre-existing intellectual property are determined by the relevant project agreement. Portfolio references do not transfer intellectual property or ownership in the underlying third-party brands.
7. Acceptable use and external links
You must not attempt to interfere with this website, gain unauthorised access, transmit malicious code, abuse enquiry forms or use its content unlawfully. We may link to websites or services operated by others, including related projects and platforms. External services have their own terms and we do not control their availability or content.
8. Liability and Australian Consumer Law
Nothing in these terms excludes, restricts or modifies rights, guarantees, remedies or liabilities that cannot lawfully be excluded under the Australian Consumer Law or other applicable law. To the extent permitted by law, website information is provided on an “as available” basis and we are not liable for indirect or consequential loss arising solely from use of general website information. Liability relating to paid services is dealt with in the applicable service agreement, subject always to non-excludable consumer and statutory rights.
9. Privacy
Our handling of personal information is described in the Privacy Policy. Please avoid submitting confidential credentials or sensitive personal information through a general contact form.
10. Governing law and changes
These website terms are governed by the laws of New South Wales, Australia, subject to any applicable mandatory rights. We may update these terms by posting an updated version on this website. Changes to these website terms do not retrospectively alter a separately accepted service contract unless agreed by its parties.
